SPECIAL MEETING

NOVEMBER 25 & DECEMBER 16, 1996

PUBLIC HEARING - CASE #423 Requesting a Text Change for Article XVII, Signs

Chairperson Joseph Uecker called the special meeting to order. The Pledge of Allegiance was given. Clerk, Eric C. Ferry called the roll. In attendance were Joseph Uecker, Jean Schmidt and Edwin H. Humphrey. Chairperson Uecker opened the Public Hearing on Case # 423 - Miami Township Zoning Commission.

Mr. Ferry read the Legal Notice of Public Hearing, the Clermont County Planning Staff Report, the Clermont County Planning Commission Report and the Miami Township Rural Zoning Commission Decision.

Miami Township Attorney, John Korfhagen presented the Board with the final draft of the proposed amendments to Article XVII: Signs recommended by the Miami Township Rural Zoning Commission. Copies of the draft have been sent to known interested parties. Mr. Korfhagen advised the Board not to vote on this case tonight but, to take the time allowed by the ORC to review comments on file and from tonight’s meeting for possible further negotiations with the interested parties.

Mr. Korfhagen answered questions from the Trustees regarding specific wording of the changes and the fee structures.

There are no adjoining property owners.

Mr. Ferry read a letter from the Ohio Valley Development Council commenting on the proposed amendments; Section 10 C-Residential Signs and Section 18-Temporary Signs.

Mr. Ferry read a letter from the Drees Company Administrative Manager, Land Development, Mr. Michael Schoettelkotte.

Chairperson Uecker called for Any Person in Attendance for statements relative to this case.

Shelia Stebbins of 6470 Wardwood Drive. She is a member of the Epiphany Methodist Church that will opening at the corner of Loveland-Miamiville Road. Their sign is 25 square feet. She asked if they should wait until a decision on this Case is made to erect the sign. The Trustee’s advised her a decision has to be made in 20 days and the Church should wait to erect the sign in case a variance is needed.

Scott Dunn of 1412 Cheltenham who is a Vice-President and Sales Manager of Sibcy Cline stated his concerns about section 6 dealing with directional signs. He requested a time frame of 90 to 120 days in which to meet with realtors and builders groups and come up with alternate plans. The Trustee’s advised Mr. Dunn that the law dictated a decision must be made in 20 days after the Public Hearing..

Gary Black of 763 Wards Corner Road stated he felt he did not receive adequate notice of the proposed changes to put together a proposal that would work for the Real Estate Companies and the Township.

Terry Masters of 493 Albino Lane, owner of Design Masters (a sign company) spoke about the concerns expressed to him by several of his builder clients, especially the elimination of anything other then text on the sign. (Section 10-C4). The other concern is for the materials allowed for the signs. Also of concern is the wording of the Temporary Subdivision Signs - mainly the overall size of the signs allowed. Mr. Masters suggested 32 square feet would probably be adequate in most cases.

Jim Keller of 11300 Cornell Park with Zaring Builders spoke about the total square footage of a sign.

Ed Humphrey made a motion to hold a Special Meeting of the Miami Township Board of Trustees on Monday, December 16th at 5:00 PM to further consider Case #423 and any other business that may come before the Board. Jean Schmidt seconded the motion. Upon roll call, all voted "AYE".

With no further business to come before the Board, Chairperson Uecker adjourned the meeting at 8:56 PM.

DECEMBER 16,1996 Continuation of Public Hearing of Case #423

Chairperson Uecker called the meeting to order. The Pledge of Allegiance was given. Mr. Ferry called the roll. In attendance were Joseph Uecker and Jean Schmidt. Mr. Ferry reported that Edwin Humphrey will be arriving later.

Chairperson Uecker continued the Public portion of Zoning Case #423.

Miami Township Attorney, John Korfhagen read correspondence from James A. Keller of Zaring Homes, Terry Masters of Design Masters and Scott Dunn of the Clermont Board of Realtors, offering suggestions for revisions to the sign program. The Board discussed the suggestions.

Mr. Scott Dunn spoke at length about the proposed amendments regarding directional signs and the placement of temporary signs in the "right of way".

Jean Schmidt made a motion to adopt the Miami Township Zoning Commission’s Resolution with the following modifications; SECTION 4 J - Eliminate. SECTION 10 C1 - Each development may have (1) sign at each major street entrance to the development. SECTION 10 C3- Each sign shall have a total message area not greater than 25 square feet per side, shall be no more than five (5) feet in height, shall have a base of not more than two (2) feet, and shall be set back at least 10 (10) feet from any right-of-way line. SECTION 10 C4 - Such signs shall include the name of the subdivision or residential development and graphics design with a variety of materials. SECTION 10 C6 - Such signs shall be effectively landscaped to provide for color, texture and variety of form. SECTION 18 2 A - The sign may be illuminated following building codes. SECTION 18 2 E- The sign shall not exceed 10 (10) feet in height, could have a maximum of two (2) sides not in excess of thirty-two (32) square feet per side. SECTION 18 2 G - to allow for renewal of permit on a yearly basis and the language as drafted by Scott N. Dunn regarding directional signs. Ed Humphrey seconded the motion. Upon roll call, all voted "AYE".

With no further business to come before the Township, Chairperson Uecker adjourned the meeting at 6:20 PM.
