RESOLUTION 2004 - 35

The Board of Trustees of Miami Township, Clermont County, Ohio met in regular session at the Miami Township Civic Building on October 5, 2004 with the following members present: Edwin H. Humphrey, Joseph W. Uecker and Mary Makley Wolff.

MRS. WOLFF made a motion to adopt the following Resolution:

RESOLUTION AUTHORIZING THE DISPOSAL OF PROPERTY, INCLUDING MOTOR VEHICLES, ROAD MACHINERY, EQUIPMENT, TOOLS, AND FORFEITED AND UNCLAIMED PROPERTY VIA PUBLIC AUCTION, DISPENSING WITH THE SECOND READING

WHEREAS, the Board of Trustees has determined that they are the owners of property, including motor vehicles, road machinery, equipment, and tools that are no longer of value and service to Miami Township, and

WHEREAS, the Board of Trustees are empowered by Section 505.10 to dispose of surplus property at public auction, and are empowered by Section 505.101 to sell of materials, equipment, or supplies to any department, agency or political subdivision of the state, and

WHEREAS, the Miami Township Police Department is in possession of miscellaneous property that it may lawfully dispose of pursuant to Section 2933.41 of the Ohio Revised Code.

NOW, THEREFORE, BE IT RESOLVED by the Board of Trustees of Miami Township, Clermont County, Ohio by authority of Chapter 504, Section 505.10, Section 505.101 and Section 2933.41 of the Ohio Revised Code, as follows:

SECTION 1: That this Board shall sell surplus property as set forth in the attached Exhibits via public auction or to any department, agency or political subdivision of the state prior to the public auction.

SECTION 2: That the public auction will occur on October 17, 2004, starting at 9:00AM, and that the notification periods required by law have been followed.

SECTION 3: The Board does hereby dispense with the requirement that this Resolution be read on two separate days, pursuant to Section 504.10 of the Ohio Revised Code, and authorizes the adoption of this Resolution upon its first reading.

SECTION 4: That this Board hereby finds and determines that all formal actions relative to the passage of this Resolution were taken in an open meeting of this Board, and that all deliberations of this Board and of its Committees, if any, which resulted in formal action, were taken in meetings open to the public, in full compliance with applicable legal requirements, including Section 121.22 of the Ohio Revised Code.

SECTION 5: This Resolution shall take effect at the earliest period allowed by law.

First Reading: October 5, 2004
Second Reading: dispensed with
Effective: November 4, 2004

MR. UECKER seconded the motion to adopt the Resolution. On the roll call being called the vote resulted as follows:
